Terms of Service

Welcome to StretchCheck. By downloading, installing, or using this app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the app.

1. Service Description

StretchCheck is a mobile application for iOS devices that provides stretching reminders and guidance with camera-based pose verification. The app uses your device's camera and Apple's Vision framework to detect body positions and verify that stretches are performed correctly.

2. Subscriptions and In-App Purchases

Free Tier

The free version of StretchCheck includes:

• 1 alarm
• 10 stretches
• Basic progress tracking
• Streak tracking

Pro Subscription

StretchCheck Pro is available as an auto-renewing subscription with the following options:

• Pro Monthly: $2.99 per month
• Pro Yearly: $19.99 per year

Pro subscription includes:

• Unlimited alarms
• All 15 stretches (5 additional Pro-exclusive stretches)
• Desk break timers
• Full body map and progress tracking
• Custom alarm sound uploads

Free Trial

New users may receive a 7-day free trial of StretchCheck Pro. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged for your chosen subscription plan.

Payment and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Cancellation

You can cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods.

3. Camera and Pose Detection

StretchCheck requires camera access to function properly. By granting camera access, you acknowledge that:

• The camera is used solely for real-time pose detection.
• No images or video are recorded, stored, or transmitted.
• You are using the camera in a safe environment where performing stretches will not cause injury or damage.

You may revoke camera access at any time in your device settings, but this will prevent the app from verifying stretches.

4. Health and Safety Disclaimer

Important: StretchCheck is designed to encourage healthy stretching habits, but it is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult with a qualified healthcare provider before starting any new exercise or stretching routine.
• Stop immediately if you experience pain, dizziness, or discomfort while stretching.
• StretchCheck is not liable for any injuries, accidents, or health issues that may occur while using the app.
• The app's pose detection is a general guide and may not be 100% accurate. Use your own judgment and listen to your body.

5. Acceptable Use

You agree to use StretchCheck only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Attempt to reverse engineer, decompile, or disassemble the app.
• Use the app in any way that could damage, disable, or impair its functionality.
• Use the app to harass, abuse, or harm others.
• Circumvent or attempt to circumvent any subscription or payment mechanisms.

6. Intellectual Property

All content in StretchCheck, including text, graphics, logos, animations, and software, is the property of Dylan Miller and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without explicit permission.

7. Limitation of Liability

To the maximum extent permitted by law, StretchCheck and its developer (Dylan Miller) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or property damage resulting from use of the app.
• Loss of data or device malfunction.
• Interruption of service or inability to access the app.

Your use of StretchCheck is at your own risk. The app is provided "as is" without warranties of any kind, either express or implied.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data (spoiler: we don't collect any).

9. Third-Party Services

StretchCheck uses Apple's App Store for payment processing and Apple's Vision framework for pose detection. Your use of these services is subject to Apple's terms and policies.

10. Termination

We reserve the right to suspend or terminate your access to StretchCheck at any time, without notice, if we believe you have violated these Terms. Upon termination, your subscription will be canceled, and you will not receive a refund for any unused portion of your subscription period.

11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will update the "Last updated" date at the top of this page and may notify you through the app or via email (if applicable). Your continued use of StretchCheck after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which the developer resides, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the use of StretchCheck will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
